(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.
(4) A business customer is a natural or legal person or a partnership with legal capacity acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
(5) Any terms and conditions of the customer that differ from these General Terms and Conditions shall not become part of the contract unless World of Wrestling expressly agrees to their application.
§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract but rather an invitation to submit an offer.
(2) Customers may place the desired products in their shopping cart. Before submitting an order, customers can review and, if necessary, correct their information.
(3) By clicking the button to place an order with an obligation to pay, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
(4) After submitting an order, the customer receives an automatically generated order confirmation by email. This initially only confirms receipt of the order.
(5) The purchase contract is concluded when World of Wrestling expressly accepts the order, sends a payment confirmation or shipping confirmation, or dispatches the ordered goods.
(6) World of Wrestling reserves the right to reject an order, particularly if an item is unavailable due to an inventory error, obvious pricing or product information errors, or other objective reasons preventing fulfillment.
(7) The contractual language is German. Depending on the configuration of the online shop, orders may also be placed in other available languages.
§ 3 Prices and Payment Terms
(1) Prices displayed in the online shop include the applicable statutory value-added tax (VAT), where applicable.
(2) Additional shipping costs may apply. The applicable shipping costs are displayed during the checkout process.
(3) Deliveries to countries outside the European Union may be subject to additional customs duties, import VAT, fees, or other charges. These are generally not collected by World of Wrestling and must be paid by the customer.
(4) The payment methods available in the online shop are displayed during checkout.
These may include:
Credit card
PayPal
Klarna or other payment methods offered through payment service providers
Advance payment/bank transfer
Additional payment methods offered through Stripe or other payment service providers
Customers are not entitled to a particular payment method.
(5) For advance payments, the invoice amount must be transferred to the bank account specified during checkout or in the order confirmation. Goods are generally dispatched only after full payment has been received.
(6) Where payment processing is carried out by an external payment service provider, the provider's additional terms and conditions may apply.
§ 4 Delivery and Product Availability
(1) Delivery is made to the shipping address provided by the customer when placing the order.
(2) The estimated delivery time is stated in the product description or elsewhere in the online shop.
(3) Delivery times are generally estimates and do not constitute guaranteed delivery dates unless a binding delivery date has been expressly agreed upon.
(4) If an ordered item is unavailable despite being displayed as in stock, World of Wrestling will inform the customer. Any payments already made for unavailable goods will be refunded.
(5) World of Wrestling may make partial deliveries where reasonable for the customer. No additional shipping costs will be charged unless expressly agreed.
(6) For consumers, the risk of accidental loss or deterioration of goods generally passes to the consumer only upon delivery to the consumer or a recipient designated by the consumer.
(7) For business customers, the statutory provisions regarding the transfer of risk apply.
§ 5 Shipping and Acceptance of Delivery
(1) Orders are shipped using the shipping service provider specified during checkout, particularly DHL.
(2) Customers must provide a complete and accurate shipping address when placing an order.
(3) If a shipment cannot be delivered due to an incorrect or incomplete address provided by the customer, failure to collect the shipment, or refusal of delivery for reasons attributable to the customer, and the goods are returned to World of Wrestling, the actual costs of reshipping may be charged to the customer where legally permissible.
(4) The customer's statutory rights, particularly in cases of justified refusal of delivery due to defective or damaged goods, remain unaffected.
§ 6 Statutory Right of Withdrawal
(1) Consumers generally have a statutory right of withdrawal for distance-selling contracts.
(2) The statutory withdrawal period is generally 14 days. Details regarding the beginning, exercise, and consequences of withdrawal are provided in the separate Withdrawal Policy of World of Wrestling.
(3) The statutory right of withdrawal remains unaffected by the following provisions concerning the voluntary 30-day return policy.
(4) Customers may inspect goods to determine their nature, characteristics, and functionality to a reasonable extent.
For shoes, this particularly includes trying them on to determine the correct size and fit, as would be possible in a physical retail store.
(5) If shoes or other goods are used or worn beyond what is necessary for such inspection, particularly during training, competitions, outdoor activities, or other sporting activities, this may result in a reduction in value.
Under the statutory requirements, the customer is liable for any diminished value resulting from handling the goods beyond what is necessary to establish their nature, characteristics, and functionality.
(6) If the original shoe box is damaged by being used as the shipping package, by directly attaching shipping labels, or by applying adhesive tape, this may result in a reduction in the value of the goods.
World of Wrestling reserves the right to claim reasonable compensation for an actual reduction in value, provided that the statutory requirements under Section 357a of the German Civil Code (BGB) are met.
No flat-rate handling fee will be charged for this. The customer's statutory right of withdrawal remains fully unaffected.
§ 7 Voluntary 30-Day Return Policy
(1) In addition to the statutory right of withdrawal, World of Wrestling grants consumers a voluntary return period of 30 days from receipt of the goods.
The statutory right of withdrawal and statutory warranty rights are not restricted by this voluntary return policy.
(2) After the statutory withdrawal period has expired, the voluntary return policy may only be exercised if the returned goods are in new, unused, and resalable condition.
Refunds under the voluntary return policy are only available for goods in new condition.
(3) Goods are considered to be in new condition under the voluntary return policy if they:
Have not been used or worn
Show no signs of use
Are not dirty or damaged
Are complete
Are in a condition that allows them to be sold as new
(4) Shoes may only be tried on to check their size and fit to the extent normally permitted in a physical retail store.
Shoes that have already been worn or used during training, competitions, outdoor activities, or other sporting activities are no longer considered new and are excluded from the voluntary 30-day return policy.
Such used shoes cannot be returned or refunded under the voluntary return policy.
(5) Shoes must be returned together with their original shoe box. The original shoe box must not be used directly as the shipping package or covered with shipping labels, adhesive tape, or other stickers.
A suitable additional outer shipping box must be used for returns.
Under the voluntary 30-day return policy, after the statutory withdrawal period has expired, acceptance of the return requires that the original shoe box is also in proper, resalable condition. The customer's statutory rights remain unaffected.
(6) Goods must be appropriately packaged for return shipping to prevent damage during transport.
(7) If returned goods can no longer be sold as new due to their condition, there is no entitlement to a return under the voluntary 30-day return policy after the statutory withdrawal period has expired.
(8) The customer's statutory rights regarding defective goods remain unaffected.
§ 8 Returns
(1) Information regarding the return process is provided on the relevant returns page of the World of Wrestling online shop.
(2) For returns from Germany, World of Wrestling provides a free return shipping label in accordance with the published return conditions.
(3) For international returns, customers generally bear the direct return shipping costs under the voluntary return policy.
The statutory provisions regarding withdrawal remain unaffected.
(4) Returns from non-EU countries must be correctly declared by the customer for customs purposes as returned goods.
The customer must ensure that the returned shipment can be delivered directly to the business address of World of Wrestling.
World of Wrestling is not obliged to collect returned shipments from customs offices, parcel shops, or other collection points.
(5) Once a return has been received, the goods will be inspected. Any applicable refund will then be issued using the original payment method unless expressly agreed otherwise.
(6) The time required for the refund to appear in the customer's account may vary depending on the payment service provider or financial institution.
(7) Statutory deadlines, particularly those relating to the statutory right of withdrawal, remain unaffected.
§ 9 No Direct Exchanges
(1) World of Wrestling generally does not offer direct exchanges for a different size, color, or product.
(2) Customers wishing to purchase a different product or size may return the original item, provided the return requirements are met, and place a new order in the online shop.
(3) The return and the new order are treated as two separate transactions.
(4) Individual goodwill arrangements remain unaffected.
§ 10 Exclusion of the Right of Withdrawal for Customized Goods
(1) Where the statutory requirements are met, the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer's personal needs.
(2) At World of Wrestling, this may particularly apply to:
Individually designed wrestling singlets
Customized club apparel
Personalized textiles
Products featuring names, initials, or individual numbers
Individually printed or embroidered products
Teamwear manufactured according to customer specifications
Custom-made products based on customer-approved designs
(3) Returns of such individually manufactured goods due to personal preference, incorrect size selection by the customer, or subsequent changes to customer requirements are generally excluded, provided that no statutory right of withdrawal exists.
(4) Statutory warranty rights for defective goods or goods not manufactured in accordance with the contract remain unaffected.
§ 11 Approval of Customized Products
(1) For customized products, World of Wrestling may provide the customer with a draft, design, visualization, or other approval document before production begins.
(2) The customer must carefully review the approval document, particularly regarding:
Spelling
Names
Numbers
Logos
Sponsor logos
Colors
Sizes
Quantities
Placement and positioning
Other design features specified by the customer
(3) By expressly approving the design, the customer confirms the accuracy of the information shown in the approval document that the customer is responsible for reviewing.
(4) After approval, changes can only be made if the production process still allows them. Any additional costs resulting from such changes may be charged to the customer following prior notification.
(5) Deviations resulting from incorrect customer information or a customer-approved design generally do not constitute a defect if World of Wrestling has manufactured the goods in accordance with the approved specifications.
(6) Minor production-related differences in color, measurements, or appearance, particularly between screen representations and finished textiles, do not constitute defects where they are customary in the industry and reasonable for the customer.
§ 12 Warranty and Defects
(1) Consumers are entitled to their statutory warranty rights.
(2) The voluntary 30-day return policy is separate from the statutory warranty.
Therefore, although a used product may be excluded from the voluntary return policy, statutory warranty rights may still apply if the product is defective.
(3) Normal wear and tear, ordinary deterioration, or damage caused by improper use, incorrect care, external influences, or use contrary to the intended purpose generally do not constitute a defect unless the statutory requirements for a defect are met.
(4) In the event of a complaint, World of Wrestling may ask the customer to provide meaningful photographs and a description of the alleged defect, where reasonable. This is intended to avoid unnecessary returns and speed up processing.
(5) The customer's statutory rights remain unaffected.
§ 13 Retention of Title
(1) The delivered goods remain the property of World of Wrestling until full payment has been received.
(2) For business customers, World of Wrestling retains ownership of the goods until all outstanding claims arising from the ongoing business relationship have been settled.
§ 14 Vouchers and Promotional Codes
(1) Promotional vouchers and discount codes may only be redeemed within the specified promotional period and under the stated conditions.
(2) Subsequent application of a discount code to an order that has already been placed is generally not possible.
(3) Unless otherwise stated, multiple discount codes cannot be combined.
(4) In the event of a full or partial return, customers are not entitled to a cash payment for an unused promotional voucher or discount.
The statutory provisions apply to gift vouchers purchased for payment.
§ 15 Liability
(1) World of Wrestling is liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
(2) In cases of slight negligence involving the breach of essential contractual obligations, World of Wrestling's liability is limited to foreseeable damages typical for the contract.
Essential contractual obligations are obligations whose fulfillment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.
(3) Liability under the German Product Liability Act and other mandatory statutory provisions remains unaffected.
§ 16 Applicable Law
(1) The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) For consumers, this choice of law applies only insofar as it does not deprive them of the protection provided by mandatory provisions of the law of the country in which they habitually reside.
§ 17 Jurisdiction for Business Customers
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the registered place of business of World of Wrestling shall be the place of jurisdiction for all disputes arising from the contractual relationship, to the extent permitted by law.
§ 18 Final Provisions
(1) If individual provisions of these General Terms and Conditions are or become wholly or partially invalid, the remaining statutory and contractual provisions shall remain unaffected.
(2) The separate Withdrawal Policy, Privacy Policy, and the shipping and returns information published in the online shop shall apply in addition to these General Terms and Conditions.
